B2B direct marketing privacy notice.
How we use business-contact information and how to exercise your rights.
You can object to direct marketing at any time. Reply to our message or email hello@vividlydigital.com. We will stop marketing to you and update our suppression records.
Updated: 8 October 2026. This notice covers business outreach. Website enquiry information is explained separately.
Who is responsible
Vividly Digital is the data controller for the business-contact information described in this notice. Contact us at hello@vividlydigital.com.
Information we use and its sources
We may use your business name, trading name, name and business role, business email and telephone number, website, business location and service area. We also keep relevant public business and Google visibility observations, the source and date of our research, correspondence, call notes, next actions, and preferences such as opt-outs or delivery failures.
Information may come from your company's website, Contact, About or Team pages, Companies House, public business profiles and directories, and similar legitimate public business sources. We also use information you provide when you communicate with us. Public availability does not mean you have consented to marketing.
Why we use it and our lawful basis
We use relevant business-contact information to identify and contact businesses about Vividly Digital's Local SEO services, follow up appropriately, respond to enquiries and manage sales conversations. Our legitimate interest is developing relevant business relationships and offering services that may help local businesses be found in Google Search and Maps.
Where appropriate, we rely on legitimate interests only after considering the purpose, whether using the information is necessary, and your reasonable expectations, interests, rights and freedoms. We limit contact to relevant business contexts, use proportionate outreach and honour objections. Where electronic-marketing rules require consent or another permitted exception, legitimate interests alone does not allow us to send marketing.
Your absolute right to object
You have an absolute right to object to the use of your personal data for direct marketing, including related profiling. No reason is required. Reply to any message asking us to stop, or email our privacy contact. We will stop direct marketing to you. If we rely on consent for any activity, you may withdraw it at any time without affecting earlier lawful processing.
Retention and suppression
We retain information only for as long as it is necessary for the relevant business-contact purpose, taking account of ongoing conversations, the accuracy and relevance of the record, and any applicable legal obligations. We review records and remove or minimise information that is no longer needed.
If you object or opt out, we retain the minimum identifying information and your preference in a suppression record so we do not contact you again by mistake. Suppression information is used to respect your request, not to continue marketing.
Who may receive information
Information may be accessed by those who need it to operate Vividly Digital's business, and by providers supporting email, record storage, CRM and administrative workflows. Our current workflow uses Gmail/Google Workspace, the Master Tracker, HubSpot and ChatGPT Work. Relevant information may also be disclosed to professional advisers or authorities where necessary or legally required.
These services may process information outside the UK. Where a restricted international transfer applies, the applicable transfer requirements must be met, such as adequacy arrangements or appropriate safeguards. Contact us for details of the providers and safeguards relevant to your information.
Your other data-protection rights
Depending on the circumstances, you can request access to your personal data, correction of inaccurate information, erasure, restriction of processing or data portability. You can also object to processing based on legitimate interests. Rights other than the objection to direct marketing may be subject to legal conditions. Contact our privacy email to make a request; we may need proportionate information to verify your identity.
Contact and complaints
For privacy questions, requests or opt-outs, email hello@vividlydigital.com. You have the right to raise a data-protection concern with the UK Information Commissioner's Office: ico.org.uk/make-a-complaint/.
How we check marketing eligibility
Before unsolicited email outreach, we check whether the contact belongs to a corporate subscriber or an individual subscriber. Sole traders and some partnerships need specific consent or a valid soft opt-in. A public email address, a relevant service or legitimate interests alone does not replace that requirement. Where subscriber status is uncertain, email outreach is held for verification.
For live marketing calls, our workflow requires checks against TPS, CTPS and our own suppression records. An email sequence being complete does not itself authorise a call.
